I. Basic Provisions

  1. These Terms and Conditions govern the contractual relationship between the Seller and the Buyer arising from the sale of goods via the Seller’s online store.
  2. The Seller is a sole trader:

  3. The Buyer is a consumer or legal entity purchasing goods outside the scope of their business activity, unless stated otherwise.
  4. Legal relations not expressly regulated herein are governed by Czech law, in particular Act No. 89/2012 Coll. (Civil Code) and Act No. 634/1992 Coll. on Consumer Protection, as well as applicable EU regulations.
  5. Purchase of goods does not grant the Buyer any rights to trademarks, logos, patents or software licenses beyond those expressly stated.

 

II. Personal Data Protection (GDPR)

  1. The Seller processes personal data in accordance with GDPR solely for the purpose of order fulfillment, communication and legal obligations.
  2. Personal data will not be disclosed to third parties except carriers and payment providers necessary to complete the order.
  3. Data are stored securely and protected by appropriate technical and organizational measures.

 

III. Ordering and Prices

  1. Orders are placed exclusively via the online shop at https://opentux.eu.
  2. Prices listed at the time of ordering are final and binding. Shipping costs are displayed separately.
  3. The Seller reserves the right to cancel or adjust an order in case of obvious pricing errors, unavailable components, or force majeure.

 

IV. Contract Conclusion

  1. The purchase contract is concluded upon confirmation of the order by the Seller or dispatch of the goods.
  2. Contracts may be concluded in Czech or English.
  3. The Buyer may correct input errors before submitting the order.

 

V. Withdrawal from the Contract

  1. The Buyer has the right to withdraw from the contract within 14 days of receipt of goods without giving a reason.
  2. Withdrawal must be sent to info@opentux.eu.
  3. Returned goods must be complete, undamaged and sent back within 14 days of withdrawal.
  4. The right of withdrawal does not apply to custom-made goods or goods modified at the Buyer’s request.
  5. The Seller will refund all received payments within 14 days after receiving the returned goods.

 

VI. Defective Performance and Warranty

  1. The Seller is responsible for defects that appear within 24 months from receipt of the goods.
  2. If a defect appears within 12 months, the goods are deemed defective upon receipt unless proven otherwise.
  3. The Buyer may request repair, replacement, reasonable discount, or withdrawal from the contract depending on the nature of the defect.
  4. Warranty does not cover normal wear, mechanical damage, improper use, or software defects under open-source licenses.

 

VII. Complaints

  1. Complaints may be submitted via e-mail or phone.
  2. Complaints are handled without undue delay, no later than 30 days from submission.

 

VIII. Product Information

  1. Product descriptions are informative and may slightly differ from the delivered goods.
  2. Prices do not include shipping unless stated otherwise.

 

IX. Payment Terms

  1. Payment methods:
    • Bank transfer or QR code
    • Card payment via PayPal
  2. Goods remain the property of the Seller until full payment is received.

 

X. Delivery

  1. Delivery is provided via selected carriers, including Packeta, within the EU.
  2. The Buyer must inspect the package upon delivery and report visible damage immediately.
  3. Failure to accept delivery may result in cancellation of the order.

 

XI. Final Provisions

  1. These Terms and Conditions are valid from 31.1.2026.
  2. The Seller reserves the right to amend these Terms and Conditions.
  3. The current version is always available on the Seller’s website.
